Welcome to The Photo Booth Guy. These Terms of Service ("Terms") govern your use of our website thepbguy.com and the photo booth rental services provided by The Photo Booth Guy ("we," "us," or "our").

By accessing our website or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Services Overview

The Photo Booth Guy provides photo booth rental services for events including but not limited to:

  • Weddings and receptions
  • Corporate events and conferences
  • Birthday parties and celebrations
  • Quinceañeras and Bar/Bat Mitzvahs
  • School events and proms
  • Holiday parties
  • Brand activations and marketing events

Our services include various photo booth types (Classic Booth, Mirror Booth, 360 Video Booth, Social Booth, Glam Booth), professional attendants, custom photo templates, props, and digital/print delivery options as specified in your service agreement.

2. Booking and Reservations

2.1 Reservation Process

To reserve our services:

  • Submit a booking request through our website or contact us directly
  • Receive and review your customized quote
  • Sign the service agreement
  • Submit the required deposit to confirm your date

2.2 Deposit and Payment

  • A non-refundable deposit is required to secure your event date
  • Deposit amounts vary by package and are specified in your service agreement
  • Final payment is due as specified in your contract (typically 7-14 days before the event)
  • We accept major credit cards, debit cards, Venmo, and Zelle

2.3 Confirmation

Your reservation is not confirmed until:

  • You have signed the service agreement
  • We have received your deposit
  • You have received written confirmation from us

3. Cancellation and Refund Policy

3.1 Client Cancellations

  • More than 90 days before event: Deposit may be applied to a future date within 12 months
  • 60-90 days before event: 50% of total booking fee is due
  • 30-59 days before event: 75% of total booking fee is due
  • Less than 30 days before event: 100% of total booking fee is due (no refund)

3.2 Date Changes

Date changes are subject to availability and must be requested in writing. One date change may be accommodated at no additional charge if requested more than 60 days before the original event date. Additional changes may incur fees.

3.3 Our Cancellations

In the unlikely event we must cancel due to circumstances within our control, you will receive a full refund of all payments made. We are not liable for any additional damages or costs incurred due to cancellation.

3.4 Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including but not limited to: natural disasters, government actions, pandemics, civil unrest, or severe weather. In such cases, we will work with you to reschedule or provide a credit for future services.

4. Event Day Requirements

4.1 Venue Requirements

You are responsible for ensuring:

  • Adequate space for the photo booth setup (requirements vary by booth type, typically 8'x8' to 10'x10')
  • Access to standard electrical outlets (110V) within 50 feet of setup location
  • Climate-controlled environment (indoor or covered outdoor with temperature between 60-85°F)
  • Protection from rain, wind, and direct sunlight for outdoor events
  • Load-in access for equipment (elevator access for venues above ground floor)

4.2 Setup and Breakdown

  • We typically arrive 60-90 minutes before your contracted start time for setup
  • Breakdown occurs after your contracted end time
  • Venue must allow adequate time for setup and breakdown

4.3 Timeline Coordination

Please provide your event timeline at least 7 days before your event. We coordinate with your venue, wedding planner, DJ, and other vendors as needed.

5. Guest Conduct and Safety

5.1 Appropriate Use

The photo booth is intended for fun, family-friendly entertainment. We reserve the right to:

  • Refuse service to intoxicated or disruptive guests
  • Remove inappropriate props or items
  • Delete photos containing inappropriate content
  • Cease operations if guest behavior poses a safety risk to our staff or equipment

5.2 Equipment Care

You are responsible for ensuring guests treat our equipment with care. Damage to equipment caused by negligence or misuse may result in repair or replacement charges.

6. Photos and Intellectual Property

6.1 Photo Ownership

Photos taken at your event are provided to you for personal use. You may share, print, and post photos on social media.

6.2 Our Usage Rights

Unless you opt out in writing before your event, we retain the right to use photos from your event for:

  • Portfolio and website display
  • Social media marketing
  • Promotional materials
  • Trade show displays

We will never sell your photos to third parties or use them for purposes unrelated to our business.

6.3 Custom Templates

Custom photo templates created for your event are designed exclusively for your use. The design work remains our intellectual property, but you receive unlimited license to use the template for personal purposes.

7. Liability and Indemnification

7.1 Limitation of Liability

Our total liability for any claims arising from our services shall not exceed the total amount paid for services. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or photos due to technical failures beyond our control
  • Delays or failures caused by venue conditions or third parties
  • Guest injuries resulting from their own actions

7.2 Insurance

We maintain comprehensive general liability insurance for our operations. Certificate of insurance is available upon request for venues that require it.

7.3 Indemnification

You agree to indemnify and hold harmless The Photo Booth Guy, its owners, employees, and contractors from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Guest conduct at your event
  • Venue-related issues not caused by us
  • Any third-party claims related to your event

8. Service Guarantee

We take pride in delivering exceptional service. If you are unsatisfied with any aspect of our service, please contact us within 7 days of your event. We will work with you to address concerns and, where appropriate, offer remedies such as:

  • Partial refund
  • Credit toward future services
  • Re-delivery of digital files

9. Website Use

9.1 Acceptable Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with website functionality
  • Collect information about other users without consent
  • Submit false or misleading information

9.2 Content Accuracy

We strive to keep website content accurate and current. However, we do not guarantee that all information is complete, accurate, or up-to-date. Prices, availability, and service details are subject to change without notice.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

10.2 Informal Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at info@thepbguy.com.

10.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in San Bernardino County, California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our website or services after changes are posted constitutes acceptance of the modified Terms.

For existing bookings, the Terms in effect at the time of booking will apply unless you agree to updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with your signed service agreement and any addenda, constitute the entire agreement between you and The Photo Booth Guy regarding our services. Any prior agreements, representations, or understandings are superseded.
